Waiver, Release of Liability, Indemnification, and Consent to Medical Attention

In exchange for my being allowed to participate in the 8th Annual Operation Charlie Bravo BRO Ride ("Event"), a motorcycle run conducted by Operation Charlie Bravo at Harley Davidson of Valparaiso, Indiana and supporting organizations and/or businesses, for the benefit of supporting Operation Charlie Bravo, I, the individual identified below and signing this document, agree to be bound by each of the following:

1. Description of Event. The Event features motorcyclists that may participate in a motorcycle ride starting in Valparaiso in the State of Indiana and ending in Valparaiso in the State of Indiana. There, the Event may include food, entertainment, and other related activities, culminating in a ride in Lake County, Indiana, Porter County, IN, Newton County, IN, and Jasper County, IN.

2. Voluntary Involvement. I understand and confirm that my involvement in the Event (as a "Volunteer") and/or my participation in the Event (as a "Participant") is voluntary.

3. Identification and Assumption of Risks. I understand that serious accidents may occur during the Event (which includes all related travel) and that Volunteers and Participants may sustain serious personal injuries, as well as property damage, as a consequence thereof. I understand these risks and know that my actions in the Event as a Volunteer and/or a Participant, may involve risk of such personal injuries and property damage, including the possibility of permanent disability and death. I understand that this Waiver and Release of Liability is intended to address all of the risks of any kind associated with my actions as a Volunteer and/or a Participant in any aspect of the Event, including, particularly, such risks created by actions, inactions, carelessness, or negligence on the part of the Operation Charlie Bravo or its directors, officers, employees, agents, volunteers, successors, assigns, or persons acting under its permission or authority. I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my actions as a Volunteer and/or a Participant in the Event.

4. Release and Waiver. I release Operation Charlie Bravo, Harley Davidson of Valparaiso, all police & fire departments of the State of Indiana, all affiliated entities of the BRO Ride, and all Event organizers, sponsors and advertisers (collectively, the "Indemnified Corporations and Individuals"), and their respective directors, trustees, officers, employees, agents, volunteers, successors, assigns, related entities, and all persons acting under their permission or authority from any and all liability for, and waive any and all claims for, injury, loss, damage, or expense, including attorneys' fees, in any way connected with my actions in the Event as a Volunteer and/or a Participant (“Claim(s)”), whether or not caused in whole or in part by the negligence or other misconduct of the Indemnified Corporations and Individuals, or any volunteer or participant in the Event.

5. Indemnification. I agree to indemnify and to hold harmless (in other words, to reimburse and to be responsible for) the Indemnified Corporations and Individuals and their directors, trustees, officers, employees, agents, volunteers, successors, assigns, and all persons acting under their permission or authority from all Claims (including the cost of defending any Claim I might make, or that might be made on my behalf, that is released or waived by this instrument) in any way connected with or arising out of my actions as a Volunteer and/or a Participant in the Event (including Claims relating to my actions while under the influence of alcohol or any other substance served or made available in connection with the Event), whether or not caused in whole or in part by the negligence or other misconduct of the Indemnified Corporations and Individuals, or their directors, trustees, officers, employees, agents, volunteers, successors, assigns, and all persons acting under their permission or authority, and any other volunteer or participant in the Event.

6. Binding Effect. This instrument shall be binding upon my relatives, personal representatives, heirs, beneficiaries, next of kin, or assigns.

7. Insurance. I understand that it is in my best interest, and that Operation Charlie Bravo encourages me, to have personal accident and medical insurance coverage to cover risks associated with my actions as a Volunteer and/or a Participant in the Event.

8. Applicable Law. This instrument shall be governed, construed, and enforced in accordance with the law of the State of Indiana.

9. Minor Participant. If an individual(s) under 18 is accompanying me in the Event, the undersigned agrees that as the parent or legal guardian of said minor individual(s), I, and my spouse or co-legal guardian, verify that I, and my spouse or co-legal guardian, fully understand, agree to, and accept all provisions of this Agreement also on behalf of said minor(s). If I am not the legal guardian, I agree to indemnify Indemnified Corporations and Individuals for any and all claim(s) brought by or on behalf of said minor(s).

THIS IS A WAIVER AND RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION. I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I AM SIGNING THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION VOLUNTARILY ON BEHALF OF MYSELF AND ANY MINOR(S) ACCOMPYING ME.
